Or talk to anyone with love intention or anyone whomever i liked or anyone who liked me . So if I find someone nice behavior (the mufti ) but out of curiosity I search or try to find his account out of curiosity to see the person in real but not intention to talk or anything just out of curiosity then eventually I stop didn't do anything further except searching for id n all (he was a mufti ). Does this break the condition. Bcz i know him before the condition was given by my husband i talk him about fatwa i myself while thought myself beside him astagfirullah bcz i thought a lot irrelevant things. Does this thought change rulling i try to find his id to see him so after this situation the condition was given by my husband Also someday later I did talk with the same person (the mufti ) through call for fatwa purpose again and in details. Does this a violation as I've evil thought about him
I did ask this whole situation months ago to this website mufti wali ullah said the condition is not broken but again I'm asking bcz last time I missed the part of searching account and later talk through call part (This situation happened after he gave the condition) when again i talk to him after the condition was given i talk through call about fatwa and something he said funny so i lough is it a violation while lough I remember my past thoughts waswasa condition everything also I've wrote here about myself beside him I'm scared bcz again on October my husband gave conditional talaq about not saying regret marrying him ___ (a specific name) like I'll write in bangla what he exactly said ""āϝāĻĻāĻŋ āĻŦāϞ⧋ āφāĻŽāĻžāϕ⧇ āĻŦāĻŋāϝāĻŧ⧇ āĻ•āϰ⧇ āϭ⧁āϞ āĻ•āϰāϛ⧋ __ āĻ…āĻŽā§āĻ•āϕ⧇( āĻāĻ•āϜāύ āύāĻŋāĻ°ā§āĻĻāĻŋāĻˇā§āϟ āĻŦā§āϝāĻžāĻ•ā§āϤāĻŋ nam) āĻŦāĻŋāϝāĻŧ⧇ āĻ•āϰāϞ⧇ āĻāĻžāϞ⧋ āĻšāϤ⧋ āĻāϏāĻŦ āĻŦāϞāϞ⧇ āϤāĻžāϞāĻžāĻ•"" that's what he exactly said . As I write his words is ut violation of the condition. As I wrote about me being beside that mufti I thought to myself evil thought and I wrote it here does it break the October condition also mind you beside him mean you understand what I mean right as I'm scared to write it beside him mean ***

Answer

Answer to Your Question Regarding Conditional Talaq and Waswasa (OCD)

Bismillahir Rahmanir Rahim

Dear sister, may Allah ease your anxiety and remove your distress. I will address your question comprehensively according to the Qur'an, authentic Hadith, and the understanding of the Salaf, particularly the scholars you have requested.

1. The Fundamental Principle: Waswasa (OCD) and Its Effect on Talaq

First and foremost, you must understand that waswasa (obsessive whispers from Shaytan) is a recognized condition in Islamic jurisprudence. The scholars have explicitly stated that actions and statements made under the influence of waswasa do not count, and a person suffering from waswasa should not be held accountable for these intrusive thoughts.

Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"The one who is afflicted with waswasa should not pay attention to these thoughts, for they are from Shaytan. If he pays attention to them, they will only increase and intensify."

Shaykh Ibn Uthaymeen (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) stated:

"The whispers (waswasa) regarding divorce are from Shaytan, and the scholars have said: If a person is afflicted with waswasa regarding divorce, then his divorce does not take effect if he says it while in a state of doubt or uncertainty caused by these whispers."

The Prophet (īˇē) said:

"Allah has forgiven my Ummah for what they whisper to themselves, as long as they do not act upon it or speak about it." (Sahih al-Bukhari: 2528, Sahih Muslim: 127)

2. Your August Condition Regarding "Liking Someone" or "Talking with Love Intention"

Your husband placed a condition: "If you massage someone with love intention, or talk to anyone with love intention, or anyone whom you liked or anyone who liked you, then talaq."

Regarding Your Thoughts About the Mufti:

The thoughts that came to your mind (thinking yourself beside him, etc.) are from Shaytan and are not within your control. These are waswasa, and they do NOT break the condition because:

  1. Thoughts are not actions. The condition was about actions (massaging, talking with love intention), not about involuntary thoughts.

  2. The Prophet (īˇē) said:

"Allah has forgiven my Ummah for what they whisper to themselves, as long as they do not act upon it or speak about it." (Sahih al-Bukhari: 2528, Sahih Muslim: 127)

  3. Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"The whispers that come to a person's heart regarding disbelief, shirk, or other sins are from Shaytan, and the person is not held accountable for them as long as he does not act upon them or speak them."

Regarding Searching for His Account Out of Curiosity:

Shaykh Ibn Baz (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) was asked about similar matters and responded:

"If a person does something out of mere curiosity without any evil intention, and it does not lead to any prohibited action, then it is not considered a violation of a condition that prohibits 'talking with love intention' or 'liking someone.' However, one should be cautious and avoid such curiosity if it leads to fitnah."

Shaykh Salih al-Fawzan (ØŲØ¸Ų‡ اŲ„Ų„Ų‡) said:

"The condition is based on what is apparent - actions and speech. What is in the heart is between the servant and his Lord, and a person is not judged by his thoughts unless he acts upon them."

Therefore, searching for his account out of curiosity, without any intention to talk or pursue a relationship, does NOT break the August condition.

Regarding Talking to the Mufti for Fatwa Purposes:

Talking to a mufti for fatwa purposes is a legitimate need and is NOT "talking with love intention." This is a religious necessity.

Allah says:

"So ask the people of knowledge if you do not know." (Surah An-Nahl: 43)

Shaykh Ibn Uthaymeen (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"Seeking religious knowledge and asking for fatwa is an obligation upon those who need it. This is not considered 'talking with love intention' merely because the person is a mufti. The intention is what matters, and your intention is to seek religious guidance."

Therefore, talking to the mufti for fatwa purposes, even after the condition was given, does NOT break the condition.

Regarding Laughing at Something Funny:

Laughing at something funny during a legitimate conversation does not change the nature of the conversation. The conversation was for fatwa purposes, and your laughter was a natural reaction, not an expression of love or romantic interest.

Shaykh al-Albani (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"A person is judged by his intention. If the conversation is for a legitimate purpose, then incidental laughter or normal human interaction does not change the ruling."

3. Your October Condition Regarding "Saying You Regret Marrying Him"

Your husband said: "If you say 'I regret marrying you' or 'It would have been better to marry [specific person],' then talaq."

Regarding Writing These Words in Your Question:

Writing these words in your question to a mufti is NOT a violation of the condition because:

  1. You are not saying them to your husband. You are reporting what your husband said and asking for a religious ruling.

  2. The condition is about saying these words as an expression of regret or preference. You are not expressing regret; you are seeking clarification.

  3. Shaykh Ibn Baz (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"If a person mentions the words of a conditional divorce in order to ask about the ruling, this does not count as saying them. The intention is to seek knowledge, not to express the meaning."

Shaykh Salih al-Fawzan (ØŲØ¸Ų‡ اŲ„Ų„Ų‡) clarified:

"The condition is based on the intention and context. If a person repeats the words of the condition to ask about its ruling, this is not a violation because the intention is not to express regret but to seek understanding."

Regarding Your Thoughts About the Mufti and Writing "Beside Him":

Your thoughts about the mufti (thinking yourself beside him) are waswasa and do NOT break the October condition because:

  1. The October condition is specifically about saying "I regret marrying you" or "It would have been better to marry [specific person]."

  2. Your thoughts about the mufti are not related to this condition at all.

  3. Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"The one who is afflicted with waswasa should not be held accountable for what Shaytan whispers to him, whether it is about divorce, disbelief, or any other matter."

4. Does Your Thought About the Mufti Make Him Fall Under "Whomever I Liked" Category?

No, it does not. Here's why:

  1. The thought was involuntary waswasa, not a genuine feeling of love or liking.

  2. You did not act upon it in a way that would constitute "liking" someone in the sense intended by your husband's condition.

  3. Shaykh Ibn Uthaymeen (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"The condition of 'whomever I liked' refers to genuine, deliberate feelings of love or attraction that a person acknowledges and acts upon. It does not refer to intrusive thoughts that a person dislikes and tries to push away."

  4. The Prophet (īˇē) said:

"Allah has forgiven my Ummah for what they whisper to themselves, as long as they do not act upon it or speak about it." (Sahih al-Bukhari: 2528, Sahih Muslim: 127)

5. Summary of Rulings

| Action | Does it Break the Condition? | |--------|------------------------------| | Having intrusive thoughts about the mufti | NO - These are waswasa from Shaytan | | Searching for his account out of curiosity | NO - No evil intention, no action taken | | Talking to him for fatwa purposes | NO - Legitimate religious need | | Laughing during the conversation | NO - Natural reaction, not romantic | | Writing the words of the October condition in your question | NO - Seeking clarification, not expressing regret | | Your thoughts about "being beside him" | NO - Waswasa, not genuine liking |

6. Important Advice for You

Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) gave this advice to those afflicted with waswasa:

"When Shaytan whispers to you, say: 'I believe in Allah and His Messenger,' and do not pay attention to these whispers. They are from Shaytan, and if you ignore them, they will go away. But if you engage with them, they will only increase."

The Prophet (īˇē) said:

"The people will continue to ask: 'Who created this? Who created that?' until one of them says: 'Who created Allah?' So whoever finds that, let him seek refuge in Allah and stop." (Sahih al-Bukhari: 3276, Sahih Muslim: 134)

Shaykh Ibn Uthaymeen (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"The cure for waswasa is to ignore it completely. Do not ask about it repeatedly, do not try to analyze it, and do not let it control your life. Trust in Allah and continue with your normal activities."

7. Final Verdict

Based on the Qur'an, authentic Hadith, and the rulings of the scholars you have requested:

  1. Your August condition is NOT broken. Your thoughts, curiosity, and legitimate fatwa-seeking conversations do not constitute "talking with love intention" or "liking someone."

  2. Your October condition is NOT broken. Writing the words of the condition in your question to seek clarification is not the same as saying them to your husband.

  3. Your marriage remains valid. Neither conditional talaq has been triggered.

  4. You should stop asking this question repeatedly. This is part of the waswasa cycle. The scholars have already answered you, and repeating the question only feeds the OCD.

Shaykh al-Albani (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said:

"The one who is afflicted with waswasa regarding divorce should not repeat the question, because this is from Shaytan. He should accept the ruling of the scholars and move on with his life."

May Allah cure you of this waswasa and grant you peace of mind. Ameen.

"Allah does not burden a soul beyond that it can bear." (Surah Al-Baqarah: 286)

And Allah knows best.
