Answer

Answer to Your Question Regarding Talaq Conditions and OCD Waswasa

Bismillah ir-Rahman ir-Raheem

Summary Answer

Your marriage is valid and intact. Neither situation resulted in talaq occurring. You are suffering from waswasa (obsessive whispers from Shaytan), and you must ignore these thoughts completely. The scholars have clearly stated that doubts and whispers about divorce do not count.

Detailed Answer

Situation 1: Saying "I give up" While Crying to Allah

Your talaq did NOT occur. Here is why:

  1. You did not have the intention of divorce. The Prophet īˇē said: "Actions are but by intentions, and every person shall have that which he intended." (Sahih al-Bukhari, Sahih Muslim)

  2. You were crying to Allah, not addressing your husband. This was a supplication (du'a) and emotional expression to Allah, not a declaration of divorce to your husband.

  3. The phrase "I give up" is not a clear word of talaq. Even if it were considered, it would only count if you had the intention of divorce.

Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "If a person says words that could be interpreted as divorce while in a state of extreme anger, sadness, or without intending divorce, then the divorce does not occur if there is doubt about his intention."

Shaykh Ibn 'Uthaymeen (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "The one who is overcome by intense emotion, such that he does not know what he is saying, his divorce does not count."

Situation 2: Singing a Song with the Word "Gave It to Someone Special"

Your talaq did NOT occur. Here is why:

  1. You did not say the exact conditional phrase. The condition was about saying "I regret marrying him" or "it would have been better to marry [specific person]." Singing a song lyric is not the same as making such a statement.

  2. You had no intention of divorce. The Prophet īˇē said: "Indeed Allah has forgiven my Ummah for mistakes, forgetfulness, and what they are forced to do." (Sahih Ibn Majah, authenticated by Shaykh al-Albani)

  3. Singing a song is not a declaration of regret about marriage. It was merely entertainment and singing along to lyrics.

Shaykh al-Albani (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "Conditional divorce only occurs when the condition is fulfilled exactly as stated, with the intention of the person making the condition."

Shaykh Ibn Baz (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "If a person says something that resembles the condition but is not exactly it, or says it without intending the condition, then the divorce does not occur."

Regarding Your OCD (Waswasa)

You are clearly suffering from waswasa (obsessive whispers from Shaytan). The scholars have given clear guidance:

The Prophet īˇē said: "Allah has forgiven my Ummah for what whispers to them, as long as they do not act upon it or speak of it." (Sahih al-Bukhari, Sahih Muslim)

Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "The one afflicted with waswasa should not pay attention to these whispers, for whoever pays attention to them will be overwhelmed by them. Rather, he should ignore them completely and seek refuge in Allah from Shaytan."

Shaykh Ibn 'Uthaymeen (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "The cure for waswasa is to ignore it completely and not to act upon it. If a person has doubts about whether he said something or not, the principle is that he did not say it."

Regarding Asking Your Husband About the Condition

Asking your husband does NOT break any condition. This is also from waswasa. The scholars have stated:

Shaykh Salih al-Fawzan (ØŲØ¸Ų‡ اŲ„Ų„Ų‡) said: "Asking about a conditional divorce does not fulfill the condition. The condition is only fulfilled by actually doing the prohibited action with full intention and awareness."

Important Principles from the Scholars

  1. The Principle of Certainty: Certainty is not removed by doubt. Since you are not certain that talaq occurred, it did not occur.

  2. The Principle of Intention: Divorce requires clear intention. Without it, no divorce occurs.

  3. The Principle of Ignoring Waswasa: The scholars unanimously agree that the one afflicted with waswasa must ignore these thoughts completely.

Shaykh al-Islam Ibn Taymiyyah (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "The Shaytan plays with the hearts of people through waswasa. The cure is to turn away from it and not to pay attention to it."

Practical Advice

  1. Do not repeat or dwell on these thoughts. Every time Shaytan whispers to you, say: "A'udhu billahi minash-shaytanir-rajim" (I seek refuge with Allah from the accursed Shaytan).

  2. Do not ask your husband again about this. Your husband already said "chill" - accept that and move on.

  3. Do not research or ask about this matter repeatedly. This feeds the waswasa.

  4. Your marriage is valid. Continue your life normally with your husband.

  5. If the waswasa becomes overwhelming, seek help from a knowledgeable scholar who understands OCD, and consider speaking to a therapist who can help you manage the OCD symptoms.

Final Verdict

Neither situation resulted in talaq. Your marriage is valid and intact. You must ignore these whispers from Shaytan completely.

Shaykh al-Albani (ØąØŲ…Ų‡ اŲ„Ų„Ų‡) said: "The one who is afflicted with waswasa regarding divorce should not give any attention to these whispers, for the Prophet īˇē said: 'Whoever hears the call to prayer and does not respond, there is no prayer for him' - meaning, do not let Shaytan play with you."

And Allah knows best.

May Allah protect you from waswasa and grant you peace of mind. Ameen.
