Answer
Answer: Waswasa Regarding Conditional Divorce and Sharing a Post
In the Name of Allah, the Most Gracious, the Most Merciful
Summary of the Ruling
Your conditional divorce (talaq) did NOT take place, and your marriage remains valid. The doubts (waswasa) you are experiencing regarding the post you shared are from Shaytan and must be ignored completely.
Detailed Answer
1. The Principle of Certainty Over Doubt
The Prophet īˇē said:
"If one of you feels something in his stomach and is uncertain whether something came out of it or not, let him not leave the mosque unless he hears a sound or smells an odor."
(Sahih Muslim, 362)
Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) said:
"The principle is that certainty is not removed by doubt. Whatever is certain remains certain until there is certainty that it has been removed. Mere doubt and uncertainty do not remove certainty."
(Majmu' al-Fatawa, 21/38)
Application: Your marriage is certain. Your husband's conditional talaq was based on a specific condition. You are now uncertain whether you fulfilled that condition. This uncertainty does NOT nullify the certainty of your marriage.
2. Regarding the Conditional Talaq
The condition your husband set was about not saying that you regret marrying him and that it would have been better to marry a specific person.
You did NOT say those words. You shared a post with a general statement about love and safety. This is not the same as the condition mentioned.
Shaykh Ibn 'Uthaymeen (may Allah have mercy on him) said:
"The conditional divorce is only fulfilled when the condition is met exactly as it was stated. If there is any doubt about whether the condition was fulfilled, then the divorce does not take place, because the principle is that the marriage remains intact."
(Ash-Sharh al-Mumti', 13/78)
3. Regarding Your Intention (Niyyah)
You stated: "I don't think while sharing the post I meant that specific person."
The Prophet īˇē said:
"Actions are only by intentions, and every person shall have what he intended."
(Sahih al-Bukhari, 1; Sahih Muslim, 1907)
Shaykh al-Albani (may Allah have mercy on him) said:
"The one who is afflicted with waswasa must not pay attention to these whispers. If he did not intend something, then it is not counted against him. The Shaytan wants to make him miserable and cause him to doubt his worship and his marriage."
(Silsilat al-Huda wa an-Nur, no. 213)
Application: Even if you shared the post, you did not intend it for that specific person. Your intention was not to express regret about your marriage. Therefore, the condition was not fulfilled.
4. The Ruling on Waswasa (Whispers of Shaytan)
The Prophet īˇē said:
"Allah has forgiven my Ummah for what whispers to them in their hearts, as long as they do not speak of it or act upon it."
(Sahih al-Bukhari, 2528; Sahih Muslim, 127)
Shaykh al-Islam Ibn Taymiyyah said:
"The one who is afflicted with waswasa should not pay attention to it, even if he is uncertain. Rather, he should turn away from it and not act upon it. If he does this, the waswasa will leave him, by Allah's permission."
(Majmu' al-Fatawa, 10/428)
Shaykh Ibn Baz (may Allah have mercy on him) said:
"Waswasa regarding divorce is from Shaytan. The believer must repel it and not pay attention to it. If a man is uncertain whether he divorced his wife or not, then the principle is that the marriage remains valid. He should not divorce her based on doubt."
(Fatawa Ibn Baz, 22/43)
5. Specific Advice for Your Situation
-
Your marriage is valid. The conditional talaq was NOT activated because:
- You did not say the specific words mentioned in the condition
- You did not intend to express regret about your marriage
- Sharing a general post about love is not equivalent to the condition
-
The post you shared was a general statement. Even if it could be interpreted in different ways, your intention was not what the condition specified.
-
Do not entertain waswasa. Shaytan wants to destroy your peace and your marriage. Ignore these whispers completely.
-
Do not repeat or dwell on these thoughts. The more you think about them, the stronger they become.
6. Practical Steps to Overcome Waswasa
Shaykh al-Fawzan (may Allah preserve him) advised:
"The treatment for waswasa is to ignore it completely, to seek refuge with Allah from Shaytan, and to occupy oneself with the remembrance of Allah. One should not ask about these whispers or try to investigate them, because this only increases them."
(Al-Muntaqa min Fatawa al-Fawzan, no. 123)
Action plan:
-
Say: "A'udhu billahi min ash-Shaytan ir-rajim" (I seek refuge with Allah from the accursed Shaytan) whenever these thoughts come.
-
Do not discuss these waswasa with others, as this feeds them.
-
Focus on your marriage and your relationship with your husband. The fact that he reacted with love to your post shows there is no issue.
-
Make du'a to Allah to protect you from waswasa and to keep your marriage blessed.
Final Ruling
Your conditional divorce did NOT take place. Your marriage is valid and intact.
The doubts you are experiencing are from Shaytan. You must ignore them completely and not act upon them. Your husband's condition was specific, and you did not fulfill it.
Shaykh al-Islam Ibn Taymiyyah said:
"Whoever is afflicted with waswasa in divorce should not pay attention to it, because the Prophet īˇē said: 'Allah has forgiven my Ummah for what whispers to them in their hearts, as long as they do not speak of it or act upon it.'"
(Majmu' al-Fatawa, 10/429)
And Allah knows best.
