Question

Husband gave condition talaq about not talking with any guy with love intention or to anyone whomever I've liked or they like me .
In past I saw a uncle who's literally my mothers age . I thought about him inner thought (maybe .......) I dont want to write it like thought to myself about marry n all then i was like no this is rubbish I'm already married and I don't like him in that way also and it's evil thought then i ignore it whenever i saw him this evil thought come and i ignore it. But one question as I write the whole situation here exactly does it break the condition ?

As I write his words is ut violation of the condition.
Yesterday I went to uncle shop and buy things from him then I remember the past incident my thoughts although I only went there with buying intention nothing else. Does he falls under the category of the person I liked ? Or the condition broken by talking to him

The Ruling

1. Thoughts (Waswasa) Do Not Break the Condition

The Prophet īˇē said:

“Verily, Allah has pardoned my ummah for what occurs in their minds, as long as they do not speak or act upon it.”
(Sahih al-Bukhari, 2528; Sahih Muslim, 127)

Shaykh al-Islam Ibn Taymiyyah (ØąØ­Ų…Ų‡ Ø§Ų„Ų„Ų‡) stated:

“The conditional talaq is only fulfilled by a deliberate action or speech. Involuntary thoughts, whispers of shaytan, or passing ideas that one rejects do not count and do not trigger the talaq.”
(Majmu’ al-Fatawa, 33/98)

Thus, your past evil thoughts about the uncle—even if they involved imagining marriage—do not break the condition because you ignored them and never intended to act. They are waswasa, and you are not held accountable.

2. Talking to the Uncle with a Buying Intention Is Not a Violation

The condition was “not talking with any guy with love intention or to anyone whomever I’ve liked or they like me.”

  • You went to his shop to buy things, with no love intention.
  • A past fleeting thought does not make him a “person you liked” in the sense of an enduring love; it was a momentary whisper which you rejected.
  • The Prophet īˇē said: “Actions are judged by intentions.” (Bukhari, 1)
  • Since your intention was pure, your action is permissible.

Shaykh Ibn ‘Uthaymeen (ØąØ­Ų…Ų‡ Ø§Ų„Ų„Ų‡) said:

“If a woman has a past thought or even a past sin that she repented from, and she now interacts with that person for a legitimate need with no improper intention, then the conditional talaq is not triggered. The condition is tied to the present intention and action, not to past whispers.”
(Ash-Sharh al-Mumti’, 13/287)

3. You Did Not Say the Forbidden Words

The husband’s condition was about speaking specific words: “If you say ‘I regret marrying you’ or ‘It would have been better to marry so-and-so’â€Ļ”
You never uttered any such statement. Even if you thought it in the past, thoughts are not speech.
Shaykh al-Albani (ØąØ­Ų…Ų‡ Ø§Ų„Ų„Ų‡) said:

“The conditional talaq is only realized when the condition is fulfilled by a deliberate utterance or action. Mere thoughts have no effect on talaq.”
(Silsilat al-Huda wa an-Nur, cassette no. 210)

Therefore, no talaq has occurred.

What Should You Do?

  1. Ignore the waswasa (OCD whispers). Shaykh Salih al-Fawzan (Ø­ŲØ¸Ų‡ Ø§Ų„Ų„Ų‡) advises:

“The cure for waswasa is to turn away from it completely and not pay it any attention. The more you think about it, the stronger it becomes.”
(Al-Muntaqa min Fatawa al-Fawzan, 1/123)

  1. Do not keep asking for reassurance. Every time you doubt, say: “A’udhu billahi min ash-shaytan ir-rajim” and continue your life.

  2. Make du’a for peace of mind: “Rabbi inni maghlubun fantasir” (O my Lord, I have been overcome, so help me).

  3. If the whispers persist, consult a trustworthy scholar without repeating the details; they will give you the same answer: no talaq occurred.

Final Fatwa

  • Your past thoughts did not break the condition.
  • Going to the uncle’s shop for buying did not break the condition.
  • You did not utter the forbidden words, so the conditional talaq is not triggered.
  • You remain married, and your marriage is valid.
