Waswasa-OCD · Ahle Hadith / Salafi
Question
In this link I didn't get the answer of 2
2.few years ago I was watching girl porn (astagfirullah I was lost I never do it again) so while watching it in orgasm time I imagine my girl class mate and did it but after that when I realized I got disgusted I don't like her that way either but while orgasm maybe I said I like her (I'm not 100% sure bcz at that moment when you sin you don't think well)
Now my question is if I talk to her is the condition broken?
(Also important my husband gave the condition talaq last year and I clarified him today before asking you that if he meant boys only so this 1 year gap I'm scared bcz I've talked to fufu my girl class mate between this lot of time )
Answer
Answer: Conditional Divorce (Talaq) and Waswasa
Summary of the Question
You are a married woman who committed a past sin of watching porn and during orgasm imagined a female classmate (maybe saying "I like her"). Your husband gave a conditional talaq last year: "if you talk to her [the classmate]…". Today you clarified with your husband, and he said he meant boys only. You have talked to your female classmate ("fufu") many times in the past year. You are now afraid the divorce has already taken place, and you also ask whether talking to her now breaks the condition.
The Ruling
1. The Condition is Interpreted by the Husband’s Intention
In the Hanbali / Salafi fiqh, a conditional divorce (ta’liq al-talaq) is binding only when the condition is clearly expressed and intended by the husband at the time of utterance. The scholars state that the meaning of the condition is based on the husband’s intention (niyyah), not on the literal wording if the wording is ambiguous.
- Shaykh al-Islam Ibn Taymiyyah said: “The condition in divorce is interpreted according to what the husband intended, just as oaths are interpreted according to the intention of the one who swears.” (Majmu’ al-Fatawa, 33/79)
- Shaykh Ibn Uthaymeen said: “If a man says to his wife, ‘If you enter this house, you are divorced,’ and he intended a specific house, then the condition applies only to that house. If he intended a general meaning, then it applies generally.” (Al-Sharh al-Mumti’, 13/245)
In your case: Your husband said today that he meant boys only when he gave the condition. This means the condition was limited to talking to boys, not to girls. Therefore, talking to your female classmate does not break the condition, and no divorce occurred. The fact that you talked to her many times in the past year is irrelevant because the condition never applied to her.
2. The Past Sin of Watching Porn and Imagining the Classmate
This past sin is a major sin that requires sincere repentance (tawbah). You have already expressed disgust and determination not to repeat it – this is the beginning of repentance. However, this sin does NOT affect the validity of the conditional divorce. The condition was about talking, not about thoughts or sins.
- Shaykh Ibn Baz said: “Sins do not nullify marriage unless they involve kufr or major shirk. A conditional divorce is only triggered by the occurrence of the specified action, not by unrelated sins.” (Fatawa Nur ‘ala al-Darb, 21/50)
3. The Doubt About Saying “I Like Her” During Orgasm
You are not 100% sure whether you said that. In Islamic law, certainty is not overruled by doubt (al-yaqin la yazulu bi al-shakk). Your marriage remains valid unless you are absolutely certain that you uttered words of kufr or divorce under the influence of arousal. Even if you did say “I like her,” that is not a statement of divorce or apostasy – it is merely a sinful desire. It does not break the condition because the condition was about talking, not about liking.
- Shaykh al-Albani said: “Whisperings (waswasa) about past sins and doubts about the validity of marriage are from Shaytan. The believer must turn away from them and trust that Allah is Oft-Forgiving.” (Silsilat al-Huda wa al-Nur, cassette 327)
Practical Advice
- Trust your husband’s clarification – He meant boys only. Do not let Shaytan make you doubt his words.
- Repent sincerely for the porn sin:
- Stop the sin immediately.
- Regret it deeply.
- Resolve never to return to it.
- Increase good deeds and seek Allah’s forgiveness.
- Ignores waswasa – Do not repeatedly check whether you talked to the classmate or whether the condition applied. Shaytan uses these doubts to distress you. Follow the principle: If you are uncertain, consider the matter as not having happened. (Qa’idah: al-asl ‘adam al-wuqu’)
- Do not ask unnecessary questions – The Prophet ﷺ said: “The children of Israel were destroyed because they asked too many questions and disputed with their prophets.” (Bukhari). Your husband has clarified; accept it.
Evidence from Quran and Sunnah
- Qur’an 4:34 – Men are in charge of women, and they may set conditions in divorce.
- Hadith: “Actions are judged by intentions, and every person will get what he intended.” (Bukhari, Muslim) – This applies to the husband’s intention in the condition.
- Hadith: “Allah has forgiven my ummah for thoughts that occur in their minds, as long as they do not speak or act upon them.” (Bukhari, Muslim) – Your past thoughts and imagination are forgiven if you repented, and they do not trigger any condition.
- Shaykh Salih al-Fawzan said: “A conditional talaq is only effective if the condition is fulfilled exactly as intended by the husband. If he meant one thing and the wife does another, the divorce does not occur.” (Al-Muntaqa min Fatawa al-Fawzan, 2/183)
Final Ruling
Your marriage is valid. No divorce has taken place because:
- Your husband meant boys only – talking to a female classmate does not fulfill the condition.
- The past sin of porn and imagination does not affect the condition.
- Doubts about what you said during orgasm are not actionable.
You may continue talking to your female classmate (fufu) without fear of divorce, but avoid unnecessary contact with non-mahram men as per the condition your husband set.
