Answer
Bismillah al-Rahman al-Rahim
We answer based on the Qurâan, authentic Sunnah, and the understanding of the Salaf, especially the major scholars you mentioned. The rulings below are given with the explicit permission of Allah, and we ask Him to grant you ease from waswasa.
Question 1
Ruling: The condition does not break.
- The automatic typing was unintentional and did not send. The Prophet īˇē said: âAllah has pardoned my Ummah for what they do unintentionallyâĻâ (Ibn Majah, sahih).
- Receiving a file from a friendâs business contact without any conversation from your side does not constitute âtalking.â
- The condition requires intentional communication with love intention. Shaykh Ibn âUthaymeen said: âConditional talaq only takes effect if the condition is fulfilled exactly as stated, with intention.â (Majmuâ Fatawa).
Conclusion: No talaq occurred.
Question 2
Ruling: The repost does not break the condition.
- You did not say the words âI regret marrying himâ or name another person. The audio is a general, poetic statement.
- The Prophet īˇē said: âActions are but by intentionsâĻâ (Bukhari). Your intention was the aesthetic graveyard, not the meaning of the audio.
- Shaykh Ibn Baz said: âA conditional oath applies only to what the person intended. Doubts and general phrases not matching the condition are disregarded.â (Majmuâ Fatawa).
Conclusion: No talaq.
Question 3
Ruling: Using a Justin Bieber song or singing it does not break the condition.
- The condition is about talking to or having love intention with a specific person (the friend). Using a song of a past celebrity is not âtalkingâ to that celebrity, nor does it imply current love.
- Listening to music may be a separate sin (if it is forbidden music), but that is unrelated to the conditional talaq.
- Shaykh al-Albani said: âA conditional divorce is tied to the exact wording and intent. General actions not mentioned in the condition do not affect it.â (Silsila al-Huda).
Conclusion: No talaq.
Question 4
Ruling: Writing a question to a fatwa site about the specific person does not break the condition.
- You are not talking to that person; you are asking a scholar for a religious ruling. This is an act of worship, not communication with the forbidden individual.
- Your husband seeing the notification and you answering âwaswasaâ is truthful â you have OCD doubts (waswasa). You did not mention the personâs name or engage in prohibited talk.
- Shaykh Ibn Taymiyyah said: âA conditional talaq only takes effect if the condition is fulfilled with full intention and action. Mere writing about the situation for a fatwa is not fulfilling the condition.â (Majmuâ al-Fatawa, 33/47).
Conclusion: No talaq.
General Advice
- Ignore waswasa. The Prophet īˇē said: âThe Shaitan comes to one of you and says âWho created this? Who created that?â until he says âWho created your Lord?â When that happens, seek refuge in Allah and stop the thought.â (Bukhari).
- Do not overanalyze accidental or unintended events. Shaykh Salih al-Fawzan said: âWaswasa is a disease; the cure is to turn away from it and not act upon it.â
- If in doubt, assume the marriage remains valid unless something certain and intentional occurs.
