Answer

Bismillah ir-Rahman ir-Raheem

Answer based on the Qur'an, authentic Hadith, and the understanding of the Salaf (as followed by Shaykh al-Islam Ibn Taymiyyah, Ibn al-Qayyim, Shaykh Ibn Baz, Shaykh al-Albani, Shaykh Ibn Uthaymeen, and Shaykh Salih al-Fawzan).

General Principle Regarding Conditional Talaq and Waswasa

Before answering each point, we must establish the ruling on waswasa (obsessive whispers) in matters of divorce.

  • The Prophet ﷺ said: “Allah has forgiven my ummah for what they whisper to themselves (hadith al-nafs), as long as they do not speak it or act upon it.” (Bukhari & Muslim)
  • Shaykh al-Islam Ibn Taymiyyah said: “If a person has waswasa, he must ignore it and not act upon it. If he is uncertain whether he said something, he should assume he did not say it, because the original state is that he did not.” (Majmu’ al-Fatawa 10/224)
  • Shaykh Ibn Baz said: “Waswasa in divorce is from Shaytan. One should not pay attention to it, and the talaq is not counted by mere thoughts or inner speech.” (Majmu’ Fatawa Ibn Baz 22/305)

Rule: For conditional talaq to take effect, the condition must be explicitly and deliberately spoken (or written/signed in a clear manner). Thoughts, inner speech (talking to oneself without moving the tongue), unintentional movements of the tongue, or writing for help (like asking a question) do not break the condition.

Answer to Each Question

1. The “Cristiano Ronaldo” Issue (Fake ID Name)

  • Your husband said: “Do not talk about that specific person.”
  • The person uses a fake ID name (e.g., “Cristiano Ronaldo”) that is not his real name.
  • You did not say the person’s real name; you only said the fake ID name while moving your tongue, and you were thinking about the condition and the person.

Ruling:

  • The condition is NOT broken.
    • Reason 1: The fake ID name is not the name your husband forbade you to mention. The condition refers to the specific person, not to every nickname or fake name. Since you did not say the person’s actual name, the condition is not violated.
    • Reason 2: Even if we assume the fake name refers to him, you were not intending to speak about him – you were merely thinking and moving your tongue involuntarily. The scholars say: A conditional talaq only counts if the forbidden action is done intentionally and with full awareness. Your movement was due to waswasa, not deliberate speech.
    • Shaykh Ibn Uthaymeen said: “If a person says a word without intending its meaning, or while under the influence of waswasa, it does not affect the talaq.” (Sharh al-Mumti’ 13/451)

Therefore: No talaq has occurred.

2. The “Regret Marrying” Issue

  • Husband gave conditional talaq: “Do not say things like ‘I regret marrying you’.”
  • Situation: Your husband said to his mother: “You are clever, if you were like his sister you would have married four times.”
  • You replied with a simple “Hum” (a sound of acknowledgment).
  • Later, you told him to stop talking about marriage because it gives you waswasa.

Analysis:

  • You did NOT say “I regret marrying you” or any similar phrase. You only said “Hum” in response to his statement. This is not a statement of regret; it is just a vague sound.
  • The condition is NOT broken.
  • Writing about this situation in your question here also does not break the condition because:
    • You are seeking a fatwa, not talking about the person in a way that violates the condition.
    • The condition was about not saying something, not about writing or asking for Islamic advice.

Therefore: No talaq.

3. Asking Questions & Using AI (ChatGPT, Grok)

  • You wrote: “I ask questions regarding that specific person topic also I search question on AI took chat gpt grok.”

Ruling:

  • This does NOT break the condition.
    • The condition was about not talking about the person (presumably verbally or in normal conversation). Asking a question to a scholar (or to an AI for research) for the purpose of understanding the ruling is not considered “talking about the person” in the forbidden sense.
    • Even if the AI gives a response, you are not engaging in conversation about that person; you are seeking knowledge.
    • Shaykh Al-Albani said: “Actions are judged by intentions. If your intention is to remove doubt or seek clarification, it is not a violation of the condition.” (Silsilat al-Huda wa an-Nur, cassette 217)

Therefore: No talaq.

5. The “Cat” Analogy (Dream of London Tour)

  • Suppose the condition was “Do not talk about the cat” (a metaphor for the actual person).
  • Your husband said he will take you to London.
  • You remembered the past (wishing to go with “the cat”) and said: “It was my dream… with you” (you corrected yourself immediately).

Ruling:

  • The condition is NOT broken.
    • Reason 1: You did not mention the person (or “cat”) directly. You said “it was my dream” – a general statement.
    • Reason 2: You immediately corrected yourself by saying “with you” (your husband), showing that you had no intention of violating the condition.
    • Reason 3: The scholars clarify: If a person inadvertently mentions something related to the forbidden topic but then stops and does not complete the thought, the condition is not broken because the condition requires a complete, intentional utterance.
    • Also, writing this analogy in your question does NOT break anything – you are using a figure of speech to ask a question, not actually talking about the person.

Therefore: No talaq.

6. Watching a Video About a Similar Situation

  • You saw a video that reminds you of the specific person and their past.
  • Question: Does watching that video break the condition?

Ruling:

  • No, it does NOT break the condition.
    • The condition was about not talking about the person, not about watching, listening, or remembering. Thoughts and memories are not under your full control.
    • Shaykh Ibn Baz said: “Waswasa and memories that come without your desire do not affect talaq. Only deliberate speech or action counts.”
    • However, if you continue to watch such videos purposefully to indulge in thoughts about that person, that may be sinful, but it still does not break the conditional talaq unless the condition specifically included “not thinking about the person.” Your husband’s condition appears to be about speaking (talking), not thinking.

Therefore: No talaq.

Important Advice to You

  1. You are suffering from severe waswasa. The Prophet ﷺ said: “Whoever persists in asking (about waswasa) will never be free of it.” (Ibn Majah). Ignore all these doubts – they are from Shaytan to destroy your marriage.
  2. Do not ask about every detail. Shaytan wants you to keep asking and doubting. Trust that your husband’s words are clear, and do not overcomplicate with hypotheticals.
  3. If you are unsure, assume the best – that the condition was not broken. The default is that your marriage is intact.
  4. Seek refuge with Allah from waswasa and recite Surah Al-Falaq and An-Nas.
  5. If you have any real concern, ask a local scholar directly once, then stop.
