Question

My husband gave me condition talaq about not saying my mother about our fight he used the exact word "niyot shoho bollam tor ma k bolle hoye jabe " he didn’t use talaq word so I took a fatwa they also said its not condition talaq he didn't use talaq word
Today we had a fight i tols my mother he asked what i told i said nothing. Then he said in past I gave you condition just to stop you and you still did it . Then he said what did you told her . I said nothing then he said 'jodi mittha bolo tahole amader hoye jabe" here also he didn't use talaq word then I told him everything what I told my mother . After the fight he said he didn't have talaq intention but I'm scared about his statement he clarify he talked about past to make me understand how he hates when I tell my mother about fight
Does this statement break or activate the past talaq or now todays statement does it break the condition
Situation 2.
My husband gave conditional talaq about not talking about a specific person or anything about him nothing at all.
What i do is whenever I have waswasa about any situation this might break condition talaq so I write my question send it to his Whatsapp and on his phone I copy the question and ask it on grok or islamqapro then after got the answer I send the link to my phone and delete the question from his phone Whatsapp (like I press delet for you option) but on my id WhatsApp I don't delete anything so that whenever I have doubt I can go and check the answer . You understand what i do right please understand my situation and give answer
So I use his phone to ask questions about that specific person condition talaq bcz I have waswasa I ask a lot of questions so what I did is copy paste my question and send to his Whatsapp then through his phone I ask questions then when received the answer I sent it to my WhatsApp through his phone and most of the time almost I deleted the question and answer link from his Whatsapp so that h doesn't read it then I'll have waswasa he never read them but from my phone Whatsapp site I didn't delete anything so that whenever I have waswasa I can go and check the answer .
Does it break the condition talaq please answer fast and accurate

Also now a situation happen basically the avobe paragraph question i already ask you in morning today and you gave ans already but now while talking to my husband he asked do you still have waswasa ? Then I said yes I even ask question (meaning this situation) then I told him I still have waswasa about the conditions I didn't only meant about the specific person wala conditional talaq I meant overall cz in past also gave condition which he cancel pay kaffara by doing roja ) so does my saying about i still have waswasa about conditions does it break the condition of talking about the specific person cz while saying this i did meant this condition at first? Also I ask him about did he ever read my questions things I asked through his phone he said no then I said I deleted everything but still did you read he said no. So does my saying I ask questions delet msg means I break the condition though he always know I ask lot of questions regarding tafweez talaq kinaya talaq condition talaq so he didn't ask much.but I'm the one whole started the conversation and told him about deleting msg asking questions everything does my now whole conversation break the condition? Please understand the whole situation and ans every detail about now conversation. I didn't delete msg from my WhatsApp but on his id I delet them maybe few left onk upore msg khuje ki delet korbo r delet na korleo husband to portese na eikhane ki somosha hobe?
Also onnodin ei specific person's condition niye apnader answer fatwa mail e ashce or phone e ami seen korsi delet kort3 vule gesi pore husband just mail e apnader nam dekhe bollo "dekho ami seen kori nai agei seen hoise (cz he knows ami ocd eigula niy3 jodi bhiy pai ) ami bolsi j ami seen korsi somosha nai eita bolar jonno ki somosha hobe condition break korbe ?

Answer

Response to Your Question

Summary of Key Rulings

1. Original Conditional Statement (About Telling Your Mother)

Your husband said: "niyot shoho bollam tor ma k bolle hoye jabe" (meaning: "I said with intention, if you tell your mother, it will happen").

Ruling: This statement does not constitute a valid conditional divorce (talaq mu'allaq) because:

  • The word "talaq" (divorce) was not explicitly uttered.
  • The expression "hoye jabe" (it will happen) is a kinayah (ambiguous) phrase.
  • According to the majority of scholars, including Shaykh Ibn Baz, Shaykh Ibn Uthaymeen, and Shaykh al-Albani, for a conditional divorce to be binding, the husband must clearly say "talaq" or a clear synonym with the intention of divorce. If he only uses an ambiguous phrase without intending divorce, no talaq occurs.

Shaykh Ibn Uthaymeen (rahimahullah) said: "If a man says, 'If you do such-and-such, then the matter is such-and-such' without mentioning talaq, then this is not talaq unless he intended talaq by it." (Fatawa al-Talaq, p. 283)

Since your husband explicitly stated he had no intention of divorce, this statement is void and does not activate anything.

2. Today's Conversation

You told your mother about the fight. Then your husband asked you what you said, and you initially lied ("nothing"). He then said: "jodi mittha bolo tahole amader hoye jabe" (if you lie, it will happen to us).

Ruling: Again, no talaq because:

  • No word "talaq" was used.
  • Your husband later clarified he had no intention of divorce; he was only trying to make you understand his dislike of you telling your mother.
  • Even if you considered the original condition, it was invalid from the start.

Conclusion: Neither the past condition nor today's statement triggers any talaq.

3. Second Conditional Talaq (About Not Talking About a Specific Person)

Your husband gave a conditional talaq regarding not talking about a specific person (or anything about him).

Your action: You use his phone to send questions about that person to yourself via WhatsApp, then delete the messages from his phone so he doesn't see them. You keep the answers on your own phone.

Ruling: This does not break the condition because:

  • You are not "talking about" that person with your husband – you are privately seeking religious guidance due to waswasa (OCD).
  • The condition likely meant not discussing that person with your husband or not engaging in conversations that cause fitnah. Using his phone privately to ask scholars does not fall under this.
  • You deleted the messages so he would not see them, showing your intention to avoid breaking the condition.

Shaykh al-Islam Ibn Taymiyyah (rahimahullah) said: "Conditions are interpreted according to the intention and custom of the one who made them. If the husband only intended to prevent a certain action that would cause harm, then actions that do not fall under that are not included." (Majmu' al-Fatawa, 33/127)

Additionally, due to your OCD (waswasa), the scholars advise ignoring obsessive doubts and not acting upon them. The Prophet īˇē said: "The Shaytan comes to one of you and says, 'Who created this? Who created that?' until he says, 'Who created your Lord?' If that happens, seek refuge with Allah and stop." (Bukhari)

4. Your Conversation About Waswasa

You told your husband: "Yes, I still have waswasa, I even ask questions (meaning the situation). I still have waswasa about the conditions."

Ruling: This does not break the condition because:

  • You were merely informing him of your mental state (waswasa).
  • You did not discuss the specific person; you spoke generally about "conditions".
  • The condition is about talking about a specific person, not about discussing your OCD or previous conditions.

5. Admitting to Deleting Messages

You told your husband: "I ask questions, I delete messages, I did this and that."

Ruling: This is not a violation of the condition. You are simply describing your past actions. The condition is about talking about that person, not about using his phone or deleting messages.

6. Forgetting to Delete an Email

You saw an answer from us on email, forgot to delete it, and your husband saw your name on it. He said, "I saw it, but I didn't read it." You admitted you saw it.

Ruling: This does not break the condition because:

  • The condition was about you talking about that person – not about an email being seen.
  • Your husband did not read the content; he only saw the sender's name.
  • You did not discuss the person with him.

7. General Advice on Waswasa (OCD)

You are clearly suffering from severe waswasa. The scholars strongly advise:

  1. Ignore all doubts – do not act upon them.
  2. Do not repeat actions (like constantly checking, deleting, asking).
  3. Seek refuge with Allah from Shaytan.
  4. Consult a trustworthy scholar once and then stop.
  5. Do not ask about every little thing – this feeds the waswasa.

Shaykh Ibn Baz (rahimahullah) said: "Waswasa is from Shaytan. The cure is to ignore it and not pay attention to it. If a person continues to doubt, he should seek refuge with Allah and stop." (Fatawa Ibn Baz, 22/325)

Shaykh al-Albani (rahimahullah) said: "The one who suffers from waswasa should not ask about every small matter, because that will only increase his confusion." (Silsilat al-Huda wa al-Nur, no. 124)

Final Verdict

Your marriage is intact. No talaq has occurred in any of these situations. All the conditions were either invalid from the start (due to lack of talaq word and intention) or were not violated by your actions. You must stop overthinking and trust that Allah knows your situation.

Action required: None. Your marriage is valid. Focus on treating your OCD through Islamic and professional means.
